CComplianceCheck 206AB and 206CCA

Section 206AB and 206CCA of Income Tax Act require tax deduction/ collection at a higher rate for non-filers of ITR. Now, Compliance Check for Sec. 206AB and 206CCA will be available to check non-filers of ITR. These provisions are applicable from 1st July, 2021. The rate will be double the rate specified or 5%, whichever is higher. These non-filers have been termed as “Specified Person” under these sections. They are those persons who have not filed latest 2 ITR, the filing date of which has been expired and the total TDS/TCS was Rs. 50000/- or more in both these 2 years. Now, how to find non-filers of ITR for the purpose of Section 206AB and 206CCA.

CBDT has issued a circular in this regard on 21.06.2021 (Circular No. 11/2021). This circular says that CBDT has come up with a new functionality called “Compliance Check for Sec. 206AB and 206CCA” With the use of this functionality, the deductor can know that who is a specified person, being non-filer of ITR as defined above.

The deductor can search a single PAN or bulk PAN nos. at the same time, as per requirement. As mentioned in circular, the department has already prepared the list of specified persons for use in current financial year. A fresh list will be provided at the start of each financial year. We will soon come up with the process of how to find non-filers of ITR using the functionality of CBDT.
